Terms of Use

In force since 17 August 2026. These terms may be updated; members are told of substantial changes.

This is a courtesy translation. The French version is the one that binds: in case of any discrepancy, it prevails. Read the French version

Article 1 — Purpose

These Terms of Use (the “Terms”) govern access to and use of the site monbookphoto.com (the “Site”), operated by GMP-Concept srl, a limited liability company incorporated under Belgian law, with its registered office at 16 avenue Lord Uxbridge, 1410 Waterloo (Belgium), registered with the Belgian Crossroads Bank for Enterprises under number 0889.209.292, VAT BE 0889.209.292.

The Site offers photographers, models and visitors a space to publish and present their work and to make contact with one another around photography.

Using the Site implies full acceptance of these Terms. A member who does not accept them must refrain from using the Site.

Hosting: OVH SAS, 2 rue Kellermann, 59100 Roubaix, France — server located in Gravelines, France.

Article 2 — Access to the Site and registration

2.1 — Minimum age. Registration is open to adults only. By creating an account, you certify that you are 18 years of age or older.

2.2 — Accuracy of information. You undertake to provide accurate information and to keep it up to date. Your e-mail address is never displayed publicly and is used only for correspondence with the Site.

Where there is serious doubt as to your age or identity, or if you lose your credentials, you may be asked for proof.

2.3 — E-mail confirmation. Confirming your address is required before you can complete your profile and publish.

2.4 — Personal account. An account is strictly personal. It may not be shared, held jointly by several people, or transferred. You alone are responsible for keeping your password confidential and for anything done from your account.

2.5 — One account per person. Opening more than one account is not permitted without the team's prior agreement.

Article 3 — Published content: ownership and licence granted to the Site

3.1 — You remain the owner. You remain the sole owner of all photographs, texts and other content you publish on the Site (the “Content”). The Site claims no ownership of your Content.

3.2 — Licence granted. By publishing Content, you grant the Site's publisher a non-exclusive, royalty-free, worldwide, transferable and sub-licensable licence to:

  • host, store, reproduce, display, perform, communicate to the public and distribute your Content;
  • alter it technically (resizing, compression, cropping, format conversion) so far as is necessary for the Site to work;
  • use it within the Site, including on portfolio pages, profile pages, the blog, artist presentation pages, and in the discovery, featuring and promotional features of the service.

3.3 — Limits of the licence. This licence is strictly limited to use connected with the operation and promotion of the Site. It does not permit the publisher to transfer your Content to third parties for independent commercial advertising purposes, or to exploit it outside the Site's ecosystem, without your specific agreement.

3.4 — End of the licence. The licence ends when you permanently remove the Content concerned, or when your account is closed, subject to copies already lawfully distributed and copies retained as part of the normal operation of the Site (backups and technical archiving).

3.5 — Removal from featured pages. You keep the right to request at any time that Content be removed from the blog or from featured pages, subject to reasonable technical delays.

Article 4 — Warranties regarding Content

4.1 — Necessary rights. By publishing Content, you warrant that you hold all necessary rights: copyright in the photograph, and the consent of the people depicted (image rights).

4.2 — Indemnity to the publisher. You indemnify the publisher against any third-party claim relating to your Content, and undertake to compensate it for the consequences of such a claim.

4.3 — Supporting evidence. In case of doubt, the team may ask you for the original file of a photograph or for written consent. Failure to respond may lead to the Content being removed.

4.4 — Image rights of the people depicted. Anyone recognisable in a published photograph may request its removal, whether or not they are a member of the Site, by writing to controle@monbookphoto.com or using the contact form. The request will be handled without any need to establish a dispute between that person and the photographer: where the existence of consent is seriously contested, the Content is withdrawn from public view while the matter is examined.

This matters on a Site where photographers and models publish the same sessions: the person photographed is not always the person who publishes.

Article 5 — Publishing rules

5.1 — Artistic purpose. The Site is dedicated to photography. Content unrelated to that purpose has no place here.

5.2 — Content classification — an obligation. The Site distinguishes three levels:

Explicit Nude including explicit exposure of the genitals

Absolute limits, whatever the classification. The Site accepts neither the depiction of a sexual act, simulated or real, alone or with others, nor the depiction of an erect penis. The Site publishes nude photography; it does not publish pornographic content.

You must classify your photographs at the level matching their actual content. That classification, and nothing else, determines who your photographs are shown to.

This obligation carries consequences. A misclassified photograph is reclassified by the team. Where breaches are repeated, your ability to publish may be restricted and then suspended. When in doubt, choose the more restrictive level.

5.3 — Prohibited content. The following are prohibited, and this list is not exhaustive:

  • any depiction of minors that is sexual or nude in character, in any form whatsoever — any content of this nature results in immediate deletion of the account and a report to the authorities;
  • content obtained or published without the consent of the people depicted;
  • content that is unlawful, threatening, harassing, defamatory, hateful, racist or discriminatory;
  • incitement to prostitution, escorting or soliciting, and any unsolicited sexual proposition;
  • advertising, spam, and links to paid services unrelated to the purpose of the Site;
  • impersonating another person or passing off their work as your own.

5.4 — The Site is not a dating site. Exchanges must remain connected to photographic activity.

5.5 — Manipulating rankings. Any attempt to distort ratings, views, votes or the ranking of a photograph artificially — in particular by creating multiple accounts or by coordinating between members — results in the votes concerned being cancelled and may result in the account being suspended.

5.6 — Other members' data. Systematically collecting, extracting or retaining other members' data is prohibited.

Article 6 — Conduct and exchanges

Exchanges between members must remain courteous. A member whose conduct is reported may receive a warning, have their account restricted, and then suspended if it happens again.

Contact limit. You may start 5 new conversations per rolling 7-day period, raised to 20 for Premium members. Replying within a conversation already open is not limited: the rule targets mass solicitation, not responsiveness. This limit may be raised individually by the team.

You are able to block another member, who will then no longer be able to write to you, and to report a message, a photograph, a comment or a profile.

Reports are reviewed by the team. The detail of moderation decisions is not disclosed.

Article 7 — Moderation

7.1 — The publisher may change the classification of, hide, remove or archive any Content that breaches these Terms or the law, and suspend or close any account concerned.

7.2 — In urgent cases — in particular the situations covered by the first bullet of article 5.3 — these measures may be taken without notice.

7.3 — Other than in urgent cases, the member concerned is informed of the measure taken.

Article 8 — Premium access

8.1 — Certain features are reserved for Premium members: themed galleries, a personal site, automatic translation, an extended rating scale, a higher publishing quota, and a contact quota raised to 20 new conversations per week.

8.2 — No paid subscription is offered at present. The Site does not sell Premium access: no price is charged, no payment is collected, no banking data is processed, and no contract for consideration is concluded between the member and the publisher.

8.3 — How it is granted. Premium status is granted by the publisher, free of charge and at its discretion. It may be withdrawn on the same terms, in particular for breach of these Terms. Its grant confers no vested right and gives rise to no compensation and no refund, both being inapplicable.

8.4 — Future opening. The publisher reserves the possibility of offering a paid subscription at a later date. Should it do so, these Terms will first be amended under article 13 to set out the price, payment arrangements, duration, cancellation and right of withdrawal. No member may be charged without having accepted those new terms.

Article 9 — Personal data

9.1 — Data controller: GMP-Concept srl.

9.2 — Data processed. Registration and profile data; published content; IP addresses and connection information; browsing data necessary for the Site to work; messages exchanged; technical data extracted from photographs (camera, lens, date taken). Any GPS coordinates present in the files are neither read, nor used, nor displayed.

9.3 — Processors. The Site uses:

9.4 — Retention periods.

  • IP addresses: 12 months
  • Requests sent to support: 24 months after closure
  • Account and content: until the account is closed, then deletion of personal data as set out in article 10

9.5 — Your rights. You have rights of access, rectification, erasure, restriction, objection and portability, which you may exercise by writing to controle@monbookphoto.com or using the contact form.

As the publisher is established in Belgium, the lead supervisory authority is the Belgian Data Protection Authority. You nonetheless keep the right to lodge a complaint with the authority of your own country of residence — the CNIL for members resident in France.

9.6 — Cookies and local storage. The Site uses only what is strictly necessary for it to work. No advertising cookie, no audience-measurement cookie and no third-party tracker is placed. No consent is therefore required and you are shown no banner; you are nonetheless entitled to this information.

Placed on your device:

  • a session cookie, which keeps you signed in during your visit;
  • an XSRF-TOKEN cookie, which protects forms against request forgery;
  • a persistent sign-in cookie, only if you tick "Remember me";
  • where applicable, a technical cookie placed by Cloudflare Turnstile during the anti-robot check on forms that can be used without an account.

The Site also uses your browser's local storage (localStorage and sessionStorage), which is subject to the same rules as cookies, in order to keep translations you have already requested so they need not be requested again, to remember that an announcement has been dismissed, and to return you to your place in a list of photographs when you navigate back. This information stays in your browser, is sent to nobody, and can be cleared at any time from its settings.

Audience measurement. As at today's date the Site operates no audience-measurement tool and uses neither Google Analytics nor any equivalent. Should such a tool be introduced, this article will first be amended under article 13, and a consent banner will be put in place if the chosen configuration requires one.

Article 10 — Closing your account

10.1 — At your initiative. You may close your account at any time from your settings. Your content ceases to be publicly accessible and your credentials are released.

10.2 — Permanent erasure. You may request permanent erasure of your data by writing to controle@monbookphoto.com or using the contact form.

10.3 — At the publisher's initiative. An account may be closed for breach of these Terms, under the conditions set out in article 7.

Article 11 — Intellectual property in the Site

The structure of the Site, its interface, its trade marks and its graphic elements are protected. Any unauthorised reproduction is prohibited. This protection does not, of course, extend to members' Content, which is governed by article 3.

Article 12 — Availability and liability

12.1 — The Site is provided “as is”. The publisher takes reasonable steps to keep it available, without guaranteeing uninterrupted access.

12.2 — The publisher cannot be held liable for Content published by members, nor for the relationships that form between them, in particular on the occasion of sessions arranged through the Site.

12.3 — Payment between members. Any mention of payment appearing on profiles is the sole responsibility of the members concerned, who are responsible for their own tax and social security obligations.

Article 13 — Changes to these Terms

These Terms may be amended. Members are informed of substantial changes, and the version in force may be consulted at any time from the footer of the Site.

Article 14 — Governing law and disputes

As the publisher is established in Belgium, these Terms are governed by Belgian law.

That choice does not, however, deprive any consumer member of the protection afforded by the mandatory provisions of the law of their country of habitual residence. A member resident in France therefore keeps the benefit of French consumer law.

In the event of a dispute, an amicable solution will be sought first. You may refer the matter free of charge to the Consumer Mediation Service (Belgium), or to the European online dispute resolution platform. Failing agreement, the dispute will be brought before the commercial court of Nivelles, without prejudice, for a consumer member, to the option of bringing proceedings before the court of their own domicile.
